Essay On Juvenile Justice Reform

Placing a juvenile in a detention center early in the court process increases the risk that youths will be found to be delinquent and damage their prospects for future success. A majority of the youths that are placed in these facilities pose little or no threat to the public and essentially do not need to be there. This portion of the juvenile court process is detrimental to the future and mental aspects of a youth’s life. We desperately need to change the way that we handle the juvenile court system because we are only reinforcing the delinquent behavior that these youths have been exposed to. We need to focus on the rehabilitation and prevention efforts for these youths not the punishment aspect and until then (insert a better ending).

The juvenile justice system is a foundation in society that is granted certain powers and responsibilities. It faces several different tasks, among the most important is maintaining order and preserving constitutional rights. When a juvenile is arrested and charged with committing a crime there are many different factors that will come in to play during the course of his arrest, trial, conviction, sentencing, and rehabilitation process. Juveniles at CCJTDC are also not given the opportunity to exercise the third central human capability. It is evident they do not have the ability to move freely from place to place, and as mentioned before, are not secure against violent assault, including but not limited to sexual assault. One can argue that the general public is not guaranteed safety, and question why deviant misbehaved children should be protected from it. There have been many studies conducted that examine ways in which the juvenile justice system responds to female offenders. Historically juvenile female offenders have been treated under status offense jurisdiction (Zahn et al., 2010, p. 10). United States Courts would exercise the principle of “parens patriae” to place the female in detention as a form of punishment for misbehavior (Sherman, 2012, pp. 1589-1590). This principle also remains prevalent as it pertains to how the juvenile justice system currently responds to juvenile female offenders.

There is much debate over whether or not juveniles should ever be tried as adults. Juveniles are defined as children under the age of 18. In the past, juveniles have been tried in a separate juvenile court because of their age. However, trying juveniles as adults for violent crimes is a trend that is on the rise. Age is supposed to be a deterrent for placing those under 18 on trial and giving them stiffer punishments that are often reserved for adults. Many debate whether or not juveniles really should have less severe punishments or if trying some juveniles as adults will lower juvenile crime rates.

During the Progressive Era - a period of industrialization, capitalism, and stratification of the class system - reformers helped establish the juvenile justice system as a way to decrease the rising juvenile crimes while also maintaining the dignity of the ‘uncontaminated’ and therefore deserving youth (Platt, 1977; Peirce, 1869). However, in reality, the complicated nature of working with children and crime have left the juvenile justice system continue to struggle with clarifying and following through with its mission. As social workers, whose mission is to strive for social justice as well as pay “particular attention to the needs and empowerment of people who are vulnerable, oppressed, and living in poverty” (NASW, 1996), it is critical that we look more closely at the reasoning behind why we are still unable to define and follow through with what social justice looks like for these youth 200 years later.

Today 's concept of the juvenile justice system is relatively new due to significant modifications in policy overtime. The justice system has been trying to figure out effective ways to treat juvenile criminal offenders successfully for years. Juveniles committing crimes is not a new issued being introduced to society; actually, it has been an issue for centuries. However, the big question is, should juveniles be tried in adult courts? Before answering, take into consideration every possible scenario that could have led them to commit the crime. For instance, were they the leader in the act? Did they participate in the crime? Was the juvenile even aware of what was taking place? Were they peer pressured? Did they have any other choice at the time? There are so many other questions we could consider when making a decision here.

The juvenile justice system is always changing and developing new ideas. The first example of a change or development can be the status offense reform. The basis of this are they are trying to keep the non-delinquent kids form the juvenile justice system. Some examples of status offenses are skipping school, or running away – offenses that are not illegal for adults. These offenses can lead to possibly detention, which might do very little to rehabilitate or change the issues that juvenile has. How this can all change is to bring these troubled kids to community based services to make them learn that it is possible to change and become a better person. Some other examples of changes or developments in our juvenile justice system (that I won’t go into detail about) are the quality of aftercare and how the system is trying to reduce racial-ethnic discrepancies and making it fairer for everyone (models for change).

This paper will discuss the history of the juvenile justice system and how it has come to be what it is today. When a juvenile offender commits a crime and is sentenced to jail or reform school, the offender goes to a separate jail or reforming place than an adult. It hasn’t always been this way. Until the early 1800’s juveniles were tried just like everyone else. Today, that is not the case. This paper will explain the reforms that have taken place within the criminal justice system that developed the juvenile justice system.

The American juvenile justice system was designed over 100 years ago to reform kids who were found guilty of minor crimes such as petty theft and truancy. Today, the system is becoming overwhelmed by crimes of violence. Stealing and skipping school have been replaced by rape and murder. The juvenile justice system was never meant to deal with these kinds of problems.

The nation’s first juvenile court was established in 1899 as a part of the Juvenile Court Act. It was founded on three principles: juveniles are not ready to be held accountable for their actions, are not yet fully developed, and can rehabilitate easier than adults. In all but three states, anyone charged with committing a criminal act before his or her eighteenth birthday is considered a juvenile offender. Now more than ever, states and countries have begun to question the reliability of the juvenile court. Some believe the juvenile court system should be abolished because of its insufficient gain to the community. Others believe children are not fully capable to understand the degree of their actions and the consequences that come from them and believe that juvenile courts are a necessity in the court system.
