Incarceration And Recidivism

This paper will discuss facts regarding the prosecution process, the concepts of incapacitation and deterrence as methods of reducing crime rates, the network of people that the prison system exposes criminals to, and the assimilation of criminals back into society as seen through recidivism rates, for the purpose of analyzing the ethical scope of the effectiveness of the process of remediation as a whole.

This paper explores the topic of mental health within prisons and how it affects the inmates. The report of my findings were through research of twelve articles, two credible website sources, and a published textbook.

For over centuries, the only form of punishment and discouragement for humans is through the prison system. Because of this, these humans or inmates, are sentenced to spend a significant part of their life in a confined, small room. With that being said, the prison life can leave a remarkable toll on the inmates life in many different categories. The first and arguably most important comes in the form of mental health. Living in prison with have a great impact on the psychological part of your life. For example, The prison life is a very much different way of life than what us “normal” humans are accustomed to living in our society. Once that inmate takes their first step inside their new society, their whole mindset on how to live and communicate changes. The inmate’s psychological beliefs about what is right and wrong are in questioned as well as everything else they learned in the outside world. In a way, prison is a never ending mind game you are playing against yourself with no chance of wining. Other than the mental aspect of prison, family plays a very important role in an inmate’s sentence. Family can be the “make it or break it” deal for a lot of inmates. It is often said that “when a person gets sentenced to prison, the whole family serves the sentence.” Well, for many inmates that is the exact case. Law enforcement officers are authorized by federal, state, and local lawmakers to arrest and confine persons suspected of crimes. The judicial system is authorized to confine persons convicted of crimes. This confinement, whether before or after a criminal conviction, is called incarceration.

Recidivism is such a significant problem here in New Mexico. Many tend to throw it off and label it “just” a prison problem. But in all reality and factuality it’s a whole lot more than that; it’s a societal problem that affects our whole community, it affects our state as a whole. Recidivism is the act of reoffending or falling back into criminal behavior after one has been incarcerated and released. Recidivism tends to more common, than uncommon here in New Mexico.

The study of recidivism amongst women in prison is important because most research focuses on the male population. The reasons for the “revolving door” phenomenon are different for women; therefore, their treatment should be more gender focused and specific to their needs. Judging by the rates at which women recidivate, you could assume that somewhere along the way the system has failed them. What role does drug use, motherhood, mental health, physical, sexual, and mental abuse play in the recidivism of female inmates?

Mass black incarceration has a myriad of effects on the culture and society of black communities across the nation. This paper examines these effects, including the reasons for black male incarceration, the widespread nature of it, the effects it has on black women, children and the community. The research was taken from several social scientists well-respected in African-American culture and includes interviews, surveys, raw statistics and data. The United States is the world’s leader in incarceration with 2.2 million people currently in the nation’s prisons or jails. Incarceration is a widely argued topic with many understood viewpoints, and it directly deals with three main important correctional topics which are deterrence, rehabilitation, and recidivism. The definition of incarceration is the state of being confined in prison. Not only does incarceration affect people directly by taking away their freedom, but it also affects their lives once their incarceration is served. There is not a whole lot to do about people being incarcerated, however, there may be ways to help the incarcerated once their freedom is restored.

In the U.S., our criminal justice system incarcerates more people than any other country on earth. Incarceration rates have skyrocketed over the past 30 years due to stricter laws and harsher penalties for drug use and possession. As a result of these high incarceration rates, many households and society, in general, has been adversely affected by the absence of men and women from their families and from their communities. While being in confinement is definitely tough on those incarcerated, the ones left on the outside are also greatly affected. Several studies have shown that this absence has had a dramatic impact on children as they struggle to survive without mothers and fathers. This is a significant sociological issue because this societal phenomenon can have lasting effects and create family voids that can contribute to the deterioration and arrested development of the offspring of those who are incarcerated.

Parole is a huge problem in america as of current. This is because the odds of the offender staying out of prison are very low. This happen because the offender does not respect the privilege of parole, to them it is just an excuse to get out of jail.

In December 2013, President Barack Obama commuted the sentences of eight federal inmates. Each had been convicted of nonviolent crack cocaine offenses, and six of whom were serving life sentences (Miles 2014). The surge in the prison population of the United States of America can be attributed to changes in sentencing and policies that created stricter laws and harsher punishments for offenders. For the last half-century, America’s attempts to get tough on crime and wage a war on drugs have landed the U.S. the highest spot on the worldwide charts in regards to prison population; only in recent years has the rate of incarceration changed course, tracking a slow, steady downward trail. Incarceration is supposed to be punishment as rehabilitation, yet it has become the primary response to crime. It is simply punishment, greatly lacking in any true form of rehabilitation

An inherent marker of this case’s problematic nature can be demonstrated within the representation of the defendants by prosecution. The defendants had their socioeconomic status and previous interactions with the ‘justice’ system flagrantly used against them. They were characterized as those people, the others, the ones who commit crimes – preying on implicit jury biases*1. Their background and the neighborhood they grew up in was used as an excuse to typecast them for a role in prison. It seems obvious that in any case, the class roles of any participants should be irrelevant unless their crime explicitly involves the matter. Instead, theirs were touted as evidence. Additionally, the defendants’ previous transgressions were brought up in an attempt to further incriminate them. Though recidivism rates are essentially astronomical in the United States, this argument is beyond irrelevant and at its heart a fallacy that should make this information irrelevant. (If the defendants had interacted with the justice system before and they were convicted of anything, then the system has failed them. It’s clearly ineffective given that in the eyes of the state the defendants were far from rehabilitated).

Just as the number of people in prison grows, so too does the number of people leaving prison. Research shows that 95 percent of all prisoners in the United States are released at some point (Katel 2009). The Department of Justice reports that more than 600,000 prisoners are released each year (John Oliver 2015). This means that hundreds of thousands of people reenter society and are expected to have learned from their time behind bars. Unfortunately, most of these people released back into society are not properly prepared. As a result, they end up back in prison.

Recidivism is one of the most fundamental concepts in criminal justice. It refers to a person's relapse into criminal behavior, often after the person receives sanctions or undergoes intervention for a previous crime. Recidivism is measured by criminal acts that resulted in rearrests, reconviction or return to prison with or without a new sentence during a three-year period following the prisoner's release (Durose et al, 2014). The main focus is to make sure these prisoners do not get back out into society and repeat their same offenses and harm others that are out in the society. Rates of recidivism reflect the degree to which released inmates have been rehabilitated and the role correctional programs play in reintegrating prisoners into society.

With the highest incarcerated rate in the world, does the United States prison systems offer quality rehabilitation or just punishment? According to data from the Bureau of Justice Statistics, there was approximately 706 prisoners per 100,000 residents, or about 2.2 million prisoners in 2012 and within 3 years, almost 6 out of 10 released inmates will be rearrested and half will be back in prison. According to data from www.gpo.gov , the vast majority of prisoners are not rehabilitated. Two-thirds of released prisoners are re-arrested and one-half are re-incarcerated within three years of release from prison. Rates of recidivism rise to approximately 75%-85% of released prisoners are likely to be re-arrested within a decade of release. Successful rehabilitation is vital when releasing an inmate into the community as it produces a significant reduction in criminal recidivism. The purpose of incarceration is to protect the public and punish as well as rehabilitate the criminal. It is designed to change an inmate's view of life and alter their future behavior when re-entering society. Prisons offer education, labor, and other rehabilitation sources to inmates, so why is the recidivism rate so high with these programs in place?
